Our Simple Succession Practice
We work directly with individuals and families after the death of a loved one, helping you oversee the orderly distribution of assets. In many cases, we can help you resolve all issues related to the division of assets through a simple succession proceeding. To qualify for simple succession, however, the estate must be relatively debt free and all heirs must agree to the succession.
To determine whether you can accomplish your objectives with a simple succession, we will first determine if the decedent engaged in any estate planning prior to death. If there is a will, we will guide you through the testate succession process, whereby our attorneys take the necessary steps to carry out your loved one's wishes as expressed in the will. If the deceased did not prepare a will, our attorneys will guide your family through the intestate succession proceeding. In this situation, the distribution of property is governed by state intestacy laws.
In our experience, the vast majority of estates can be resolved with a simple succession, a process that customarily can be completed in just a few days, provided all necessary information is available and all of the heirs' signatures can be obtained. We normally handle simple successions on a flat fee basis, with fees running from $1000 to $2500, plus court costs and recording fees.
